Notes on this code
These notes are part of the regulation. They change how the levels above are applied.
- Note: It is required for the minimum ratings for residuals under diagnostic codes 8000-8025, that there be ascertainable residuals. Determinations as to the presence of residuals not capable of objective verification, i.e., headaches, dizziness, fatigability, must be approached on the basis of the diagnosis recorded; subjective residuals will be accepted when consistent with the disease and not more likely attributable to other disease or no disease. It is of exceptional importance that when ratings in excess of the prescribed minimum ratings are assigned, the diagnostic codes utilized as bases of evaluation be cited, in addition to the codes identifying the diagnoses.
Brain Hemorrhage (Hemorrhage from Brain Vessels)
VA Diagnostic Code 8009 · 38 CFR § 4.124a · Neurological Conditions and Convulsive Disorders
Understanding This Condition
Diagnostic Code 8009 covers hemorrhage from the vessels of the brain. It falls under the VA's rating rules for neurological conditions and convulsive disorders, found in 38 CFR § 4.124a.
Because a brain hemorrhage can affect people differently over time, the VA rates it in two phases: an initial period following the event, and an ongoing period based on any lasting effects (residuals).
Available Rating Levels
| Rating | What It Reflects |
|---|---|
| 100% | The vascular condition is rated under Codes 8007 through 8009 for 6 months. |
| 10% | The minimum rating for residuals, thereafter. |
In practice, this means the condition is rated at 100% for the first 6-month period, after which it is rated based on the residuals that remain, with 10% set as the minimum.
What the VA Looks For
- Ascertainable residuals. For the minimum ratings for residuals under diagnostic codes 8000–8025, there must be ascertainable residuals.
- How subjective symptoms are handled. Determinations about residuals that cannot be objectively verified — such as headaches, dizziness, and fatigability — are approached on the basis of the diagnosis recorded. Subjective residuals will be accepted when they are consistent with the disease and are not more likely attributable to another disease or to no disease.
- Citing the basis for higher ratings. When ratings above the prescribed minimum are assigned, it is of exceptional importance that the diagnostic codes used as the basis of evaluation be cited, in addition to the codes identifying the diagnoses.
This information is drawn directly from the VA rating schedule under 38 CFR § 4.124a, Diagnostic Code 8009. Individual ratings depend on the specific facts of each case as evaluated by the VA.
