Notes on this code
These notes are part of the regulation. They change how the levels above are applied.
- Note 1: Continue the rating of 100 percent for the duration of treatment for active disease followed by a mandatory VA exam. If there is no relapse, rate on residuals. Any change in evaluation based upon that or any subsequent examination shall be subject to the provisions of § 3.105(e) of this chapter.
- Note 2: Confirm the recurrence of active infection by culture, histopathology, or other diagnostic laboratory testing.
- Note 3: Rate under the appropriate body system any residual disability of infection which includes, but is not limited to, skin conditions and conditions of the respiratory, central nervous, musculoskeletal, ocular, gastrointestinal, and genitourinary systems and those residuals listed in § 4.88c.

Body System: Infectious Diseases, Immune Disorders and Nutritional Deficiencies · Rated under 38 CFR § 4.88b
Understanding This Condition
Nontuberculosis mycobacterium infection is an infectious disease evaluated by the VA under Diagnostic Code 6312. Because the impact of this condition can change over time, the VA rating approach accounts for two distinct phases: the period of active disease and the period afterward, when any lasting effects (residuals) are evaluated.
Available Rating Levels

What the VA Looks For
When rating this condition, the VA considers the following:
-
Duration of the 100% rating. The 100 percent evaluation continues for the duration of treatment for active disease. This is followed by a mandatory VA examination. If there is no relapse, the condition is then rated on its residuals. Any change in evaluation based on that examination — or any subsequent examination — is subject to the provisions of § 3.105(e).
-
Confirming recurrence. A recurrence of active infection is confirmed by culture, histopathology, or other diagnostic laboratory testing.
-
Rating residual disability. Any residual disability from the infection is rated under the appropriate body system. Residuals include, but are not limited to, skin conditions and conditions of the respiratory, central nervous, musculoskeletal, ocular, gastrointestinal, and genitourinary systems, as well as those residuals listed in § 4.88c.
This overview is grounded in the VA rating schedule for Diagnostic Code 6312 (38 CFR § 4.88b). Individual evaluations depend on medical evidence and examination findings.

Knowing the criteria is the first half. Getting your file to show them is the second.
Find your level in the stack
Read each rung against what your medical records already say. The level your records document today is the one the VA can support today.
Name the gap
Look at the rung above yours and write down exactly what it asks for that your file does not show yet — a diagnosis, a measurement, a prescribed brace, a doctor’s opinion linking it to service.
Claim it by code
File under diagnostic code 6312 and attach the evidence for the level you are asking for. Other Infectious Diseases, Immune Disorders and Nutritional Deficiencies codes may cover your secondary conditions.
