## Notes

- Note: It is required for the minimum ratings for residuals under diagnostic codes 8000-8025, that there be ascertainable residuals. Determinations as to the presence of residuals not capable of objective verification, i.e., headaches, dizziness, fatigability, must be approached on the basis of the diagnosis recorded; subjective residuals will be accepted when consistent with the disease and not more likely attributable to other disease or no disease. It is of exceptional importance that when ratings in excess of the prescribed minimum ratings are assigned, the diagnostic codes utilized as bases of evaluation be cited, in addition to the codes identifying the diagnoses.

## Understanding This Condition

Hematomyelia is a neurological condition rated by the VA under Diagnostic Code 8012, part of the group of neurological and convulsive disorders addressed in 38 CFR § 4.124a.

The VA rates this condition in two stages: an initial period following the active condition, and an ongoing evaluation based on any lasting effects, or "residuals," that remain afterward.

## Available Rating Levels

| **100%** | For 6 months |
| **10%** | Rate residuals, minimum |

- A **100% rating** is assigned for a period of 6 months.
- After that period, the condition is rated based on its **residuals**, with a **minimum rating of 10%**.

## What the VA Looks For

For the minimum ratings for residuals under diagnostic codes 8000–8025, the VA requires that there be **ascertainable residuals**.

Some effects cannot always be objectively verified — for example, headaches, dizziness, and fatigability. The VA notes that determinations about these residuals must be approached on the basis of the diagnosis recorded. **Subjective residuals will be accepted when they are consistent with the disease** and are not more likely attributable to another disease or to no disease at all.

When ratings higher than the prescribed minimum are assigned, it is considered of exceptional importance that the diagnostic codes used as the basis of evaluation be cited, in addition to the codes identifying the diagnoses.
